Content
Client agrees to take sole responsibility for all content. Provider is not liable for any action taken against a client as a result of their stream content.
 
Content Restrictions
Provider will monitor Stream connections and the amount of data streamed, if any client is found to be using their server(s) over the contracted Kbps bitrate, NWR reserve the right to terminate your service immediately without refund.

If it is brought to the attention of NWR that illegal content is being streamed then NWR will terminate all services without refund.

The client should not, however, use server resources for any illegal activity, including the sharing of copyrighted programs, cracks, and serials, as well as slanderous material. Client will not run any program or robot that is specifically designed to impede server resources. Broadcasting at any streaming bit rate higher than the bit rate paid for may result in immediate account termination.
 
Adult Content
NWR does not allow Adult content, any client found streaming Adult material will result in their account being terminated without refund.

 
Licenses
Effective 4/1/2009 the client is solely responsible for any applicable license fees for their location. NWR does not award free licensing to clients, such as PRS, PPL, MCPS, ASCAP, BMI, SESAC, RIAA or CARP. Reporting and paying for any and all royalties are the responsibility of the client. Stations that are programmed or developed for clients are done so as a consultant and ownership of said station is that of the client.

 
Liability
Provider will not be held liable for any injury, loss of property, loss of data, or other mishap caused by the use of provider's services. Provider will make every effort to provide an uninterrupted Internet connection; however we do not warrant that the Internet connection will be error free or uninterrupted. We perform full monthly and weekly incremental back-ups; however, Provider shall not be liable for any indirect, incidental or consequential damages (including lost data, information, or profits) sustained or incurred in connection with lost data.

In consideration for the privilege of using Provider's streaming media services, you hereby release NWR, from any and all claims of any nature arising from the use, or inability to use, the Internet connection. Provider will not review materials on our server as a matter of course, but if it comes to our attention that you are hosting material that violates our terms of service, we will investigate and take action. The client understands and agrees that Provider reserve the right to immediately close any account that violates our Terms of Service.

Provider is hereby waived of any legal obligation pertaining to the use of our service.

 
Spam
Client will not use our resources to transmit bulk or spam E-mail. This is defined as mail sent to a large group of recipients who did not expressly request to be sent the mail.

 
Privacy
Provider will not release any personal information about our clients, unless permission is expressly granted. Some information may be made public, if client chooses to list their content in our online directory.

 
Payment
Payment for services will be collected before an account is created. Payment for subsequent months will be charged monthly in advance, unless client is told otherwise. Uncleared payments will caused any services to be delayed until clearance of funds has occurred.

All Payments to Provider are non-Refundable.

 
Cancellation
Requests for cancelling accounts may be made with at least 30 working days notice. Client must have all account information in order to be able to cancel the account. Client also understands and agrees by these terms of service that all payments to Provider are non-refundable.

 
Product Misuse
If customers are found to go over the assigned contracted Kbps bitrate then the product purchased or the customer account may be closed by the provider. NWR may re-enable products/accounts, however any breaches in the product specifications bought are considered against the acceptable use policy and will be treated as such.

 
Product Reselling
If a customer is found to be reselling a NWR product, NWR will immediately disable all products of that customer and de-activate their account with no refund. The decision to disable the account is final and there are no appeals

 
Product Offers
Any offers made to a customer are offered based on the terms agreed at the time. Any changes made by the customer which causes these terms to be breached revokes any offer made by Planet Caroline Internet Streaming. No reversal will be made and any monies outstanding/required will need to be paid by the customer.

 
Directory Listings
Any client found to be broadcasting material which causes any issues relating to any directory listings , such as the Shoutcast YP, will have their account terminated without refund.

 
Amendments
Amendments to this agreement may be made at any time. No notification will occur to clients when changes are made and it is the responsibility of the client to check the terms and conditions on a regular basis.  Customers accepting service accept all terms and conditions as well.
